Terms of Reference (ToR) for Consultant
Nepal Disabled Women Association (NDWA) was established in 2054 (1998) adopting the values of the fundamental rights and responsibilities provided by the constitution of Nepal. It aims to support Women with Disabilities (WWDs) to pursue their rights, and provide them protection and livelihood support. Unless WWDs from all sections of the Nepalese community understand and exercise their human rights, particularly as ensured by the UN Convention on Rights of Persons with Disabilities, their lives will not be bright and prosperous. Therefore, NDWA promotes programs to build the capacity of the WWDs living in both urban and remote areas of the country, enabling them to become capable, empowered, and proactive in exercising their rights. It is also vital to empower women from other disadvantaged communities, such as women with disabilities from Dalit and Madhesi community, to build their self- esteem and confidence. In this context, NDWA plays an important role to advocate on the issues of WWDs, including rights to education, health, employment, rehabilitation and social security.

Terms of Reference (ToR) for Consultant
Activity: Carry out legal review on Free and Compulsory Education Act, 2075
Objective
To carry out legal review on Free and Compulsory Education Act, 2075 which will help to identify policy and implementation gaps and CSOs recommendations to policymakers.
Scope of Work
The consultant will be responsible for a desk legal review on Free and Compulsory Education Act 2075, connecting with the provisions mentioned in the constitution of Nepal. The consultant will also review School Education Sector Plan (SESP), Real Plan, Act relating to Children 2075, Girls and Inclusive Education, Inclusive Education Network Strategy, 2080 and National Framework of Child Friendly Schools for Quality Education,2010. The consultant will review these policies and connect with the Free and Compulsory Education Act, 2075 and identify gaps in the policy and implementation.
A detailed analysis will be carried out through which legal gaps and opportunities will be identified for promoting inclusive education through Gender Equality Disabilities and Social Inclusion lens review will be conducted to see how the act aligns with the UN Convention on the Rights of Persons with Disabilities (CRPD), CEDAW, and SDG 4.5 (equity in education).
Expected results:
- The consultant will review existing legal provisions and gaps in the act aligning with UNCRPD, ARPD, inclusive education (disability lens) and gender lens.
- Some practical recommendation from the act will be drawn up for its effective implementation and the findings will be shared during the local, provincial and federal dialogues and discourse.
- This study will serve as tool for the advocacy based on the gaps found by this review.
Required Expertise
- Advanced degree (Masters’ or Ph.D.) in Law, Social Sciences, Education, Gender Studies, Disability Studies, or a related field.
- Familiarity with national international legislative frameworks, policies, and guidelines in the context of disability and education, particularly in Nepal along with strong understanding of CRPD
- Strong analytical skills and ability to synthesize complex information into clear, actionable recommendations.
- Excellent written and verbal communication skills, with the ability to present findings to diverse audiences
Duration
The assignment is expected to be completed by one month from the date of signing the contract.
