Situation analysis of the human rights violation of persons with mental health conditions and psychosocial disability/issues in Sudurpaschim province

1. Background

KOSHISH is a non-government organization, established in 2008, and working for the promotion of mental health and psychosocial well-being in Nepal. The organization has been implementing "De-stigmatization of Psychosocial Disability through Media Engagement" in partnership with International Disability Alliance (IDA) in Dhangadhi Sub Metropolitan City and Kailari Rural Municipality of Kaliali district. The project aims to destigmatize the myths and stereotypes associated with the person with mental health conditions and psychosocial disabilities through media engagement. To explore such situations in the grassroot community, the project is planning to conduct a situation analysis of the human rights violation of persons with mental health conditions and psychosocial disabilities in the said project area.

2. Objectives:

  • To examine the social and attitudinal barriers (major focus on employment, participation in social activities, and inclusion of mainstream groups within the community; and family and community perceptions) that contribute to the exclusion of persons with mental health conditions and psychosocial disabilities within family and community;
  • To collect information regarding the perception and knowledge of duty bearers against these barriers and their commitment to ensure the rights of persons with mental health conditions and psychosocial disabilities;
  • To assess the accessibility and effectiveness of the government entitlements and social inclusion of persons with mental health conditions and psychosocial disabilities.

3. Scope of the work and key activities:

The situation analysis will be conducted in Dhangadhi sub-metropolitan city and Kailari Rural municipality of Kailali district.

  • Review the previous situational analysis reports.
  • Review the relevant national and international literature, reports, or published materials about human rights violations, barriers to community inclusion and independent living.
  • Design the study, methodology, and appropriate data collection tools in consultation with project to identify the gaps, problems, and possible solutions.
  • Visit the grassroots community of the project area and collect the evidence of an individual (case story model) against the major provision of CRPD, Disability Rights Acts and existing national laws and policies of Nepal. And ensure the proper inclusion of geography, age, sex, gender, socio-economic status and ethnicity are included in the survey.
  • Prepare an analytical and comparative report in Nepali and English and submit draft to KOSHISH.
  • Submission of the final report to KOSHISH as per the inputs provided.

Further Suggested Methodology and Analytical Approach:

This study will adopt both a quantitative and qualitative approach as appropriate to the objectives of the study.

Primary data will be collected through appropriate tools and techniques. The major respondents will be the person with mental health conditions and psychosocial disability, their families and caregivers. Basically, the study examines the discrimination and barriers (social and attitudinal) they (including their family) face. Likewise, the study captures community perceptions towards them, their struggle against the perpetuated stereotypes and stigma, family and community support, access to disability ID cards and government entitlements, participation in social activities, inclusion within family and community. The study will further conduct some in-depth interviews with some purposively selected persons and their families to capture the story of discrimination and violation of their human rights. The study will also conduct the same interviews with the key duty bearers of local and province levels to analyze the available community services and access to person with mental health conditions and psychosocial disabilities to access these services.

4. Responsibility of KOSHISH

KOSHISH will be responsible to facilitate the situation analysis. Specifically, KOSHISH will:

  • Provide project-related information, and documents;
  • Provide inputs to finalize design, methodology and tool for the situation analysis;
  • Support to arrange required meetings, and consultations with family, community, stakeholders and beneficiaries;
  • Give inputs on draft and final reports;

5. Assignment Period

The tentative period of the assignment will be one month. Expected to commence from 18th June to 17th July 2023 including field-related activities and report preparation.

6. Budget and payment procedures:

The budget covers consultancy fees along with travel, accommodation and other costs. The final budget will be agreed upon between the KOSHISH and the consultant/firm prior to signing the agreement.

  • 40% upon submission and approval of the draft report
  • 60% upon acceptance of the final report.

7. Other benefits:

The consultant is not entitled to other benefits (such as insurance) and other hidden costs.

8. Required competencies and qualifications:

  • Potential candidate should possess the following qualification and skills:
  • A minimum Master’s Degree in Law, Social science, Project management, or a related field with 5 years of experience in the disability rights field).
  • The consultant should have experience in conducting research, studies, evaluation, and assessments on disability, with knowledge and expertise in Law, UNCRPD, and human rights instruments.
  • Experience in qualitative and quantitative research, data collection, and data analysis.
  • Good understanding of national disability-specific laws, regulations, and policies and knowledge of legal analysis from the disability perspective.
  • Proven experience in doing research and studies on disability issues and other social issues along with good skills in designing research tools and good command of report writing in English and Nepali.
  • High level of knowledge and skills in report writing in English and Nepali language.
