Background & Project Description: 

In September 2017, the U.S. Government’s Millennium Challenge Corporation (MCC) signed a $500 million compact agreement with the Government of Nepal. The compact aims to increase the availability and reliability of electricity, maintain road quality, and facilitate power trade between Nepal and India - helping to spur investments, and accelerate economic growth.  The compact agreement is valid for a period of five years, and is currently in implementation stage, prior to Entry-Into-Force (EIF) at which time the five-year time period begins. 

Pursuant to the aforementioned agreement, the entity charged with implementing the project has been established as the Millennium Challenge Account Nepal (MCA-N) entity. This position will assume a critical role in the success of MCA-N. 

Position Objective: 

The Procurement Manager-Program Procurement under the supervision of the Deputy Executive Director/Deputy Chief Executive Officer (DED/ DCEO) for Management, is responsible for overseeing the delivery and implementation of procurement-related services that include resource acquisition, inventory management, and stock quality control of goods and services relevant to wider organization programs. 

Duties and Responsibilities

Operations  

  • Manages and oversees all procurement operations and the performance of the Procurement Agent(s). Manages the flow of procurement activity to implement the Compact 
  • Ensures that all procurement transactions are implemented in accordance with the MCC Program Procurement Guideline  
  • Works closely with the management and the ED/CEO of MCA-N to maintain the integrity and confidentiality of the procurement process 
  • Works closely with the Procurement Agent(s) and serves as the primary liaison between the Procurement Agent(s), MCC, and outside entities from a variety of specialized sectors on all procurement activities and facilitates the smooth interplay between and among all elements of the procurement process 
  • Translates program requirements into actionable procurement packages and requisitions, in coordination with the Project Managers 

Planning 

  • Plans, organizes, and guides the PA in conducting market/industry outreach activities and analyzes market conditions in order to inform the packaging of project objectives into procurable requirements, promote competition, and optimize the likelihood of success of the resulting procurement activity 
  • Coordinates the functions of MCA-N and the Procurement Agent(s) in implementing the Compact program, including identifying initial procurement needs and organizing procurement operations 
  • Facilitates the preparation and submission to the Procurement Agent(s) of necessary procurement documents (requisition, Terms of Reference, estimated budgets etc.) provided by the technical staff of MCA-N 
  • Ensures that the solicitation documents, Procurement Plans, Procurement Implementation Plans, and all other required documents prepared by the Procurement Agent(s) and comply with the MCC Program Procurement Guidelines and Standard Bidding Documents, and they meet the procurement needs of MCA-N and follow the Procurement Operations Manual and other relevant templates of MCA-N 
  • Establishes and communicates procurement priorities to Procurement Agent(s), in consultation with the MCA-N management and Project Managers 
  • Ensures that the Procurement Agent acts consistently with the approved Procurement Operations Manual 

Monitoring & Evaluation 

  • Actively monitors and manages the progress of procurements against the applicable Procurement Implementation Plan. Coordinates with MCA-N management and project staff to ensure everyone understands their respective roles and responsibilities in the execution of procurements, appreciates the critical nature of their responsibilities and are aware of the serious consequences of missed deadlines and unacceptable inputs 
  • Regularly reviews MCA-N’s Procurement Operations Manual(s) and Contract Administration Manual(s) prepared by the Procurement Agent(s) and recommends any necessary changes or improvements to ensure it responds to the operational reality of MCA 
  • Leads, guides, and manages the members of the MCA-N procurement team. Manages and reviews the work of the MCA-N procurement team to ensure quality of outputs, and provides day-to-day supervision of MCA-N procurement unit staff 
  • Approves procurement decisions in accordance with Attachment 1 to the MCC Program Procurement Guidelines within the approval thresholds and reviews those that require MCC and the MCA-N Governing Body approval prior to submission to these entities 
  • Assists Project Managers, and Legal Counsel in interpreting and applying various contractual provisions, in particular with respect to claims from contractors for time extensions or extra payments, and in general with respect to the contractors’ and consultants’ conformance and compliance with contractual obligations 
  • Oversees, in coordination with Project Directors and Project Managers, the contract amendment/modification process and ensures that the approval authorities in Attachment 1 of the MCC Program Procurement Guidelines are adhered to in this regard 
  • Develops and applies fraud and corruption awareness and anti-fraud and corruption measures, with emphasis on the procurement and contract execution processes, in collaboration with the Procurement Officers, Procurement Agent(s), Project Directors, Project Managers, the fiscal team, and the MCA-N legal team 
  • In consultation with the MCA-N Management and legal Counsel ensures the development of the MCA-N specific Bid Challenge System in accordance with the appropriate MCC guidelines 
  • Participates in the review of the Bid Challenges received from aggrieved bidders in accordance with the MCC approved Bid Challenge System (BCS) 
  • In consultation with the MCA-N Project Managers, ensures that the Contract Administration and Management Manual (CAMM) is generated and agreed in good time before the contract administration process and management period begins 
  • Reviews reports submitted by the Procurement Agent(s) 
  • Ensures that the Procurement Agent keeps records of all procurement activities during the procurement phase and also during the Contract Administration phase 

Requirements (Education, Experience, Technical Competencies): 

Mandatory requirements: 

  • Bachelors’ Degree (Required) and Master’s Degree preferred from a recognized institution in the following or equivalent fields: Procurement, Business Administration, Business Management, Law, Contract Law, Contract Management, Supply Chain Management, Logistics, Economics, Engineering 
  • Minimum seven (7) years of cumulative experience (accumulated after acquisition of Bachelor’s Degree) in senior position(s) or in senior advisory role(s) in the management of project(s) that required procurement of goods, works and services (a written test to gauge procurement knowledge may be given to short-listed candidates) 
  • Experience drafting, reviewing, and approving procurement documents 
  • Demonstrated knowledge of or experience with procurement policies of World Bank, Asian Development Bank, MCC (or other international donor institutions) 
  • Demonstrated abilities to coordinate teams; prioritize tasks; and monitor performance against schedule and KPIs for own team and for contractors 
  • Demonstrated track record of delivering high quality outcomes/projects on time and within budget; 
  • Proven capacity to work with a minimum of supervision and make independent assessments and decisions 
  • Fluency in English; and 
  • Strong computer skills with office productivity applications (Word, Excel, PowerPoint, MS Project) 

Preferred requirements:

  • Experience in management of similar projects preferably at the enterprise or organization level 
  • Dynamic, solution-driven, proactive personality (reference checks required); and  
  • Familiarity with the energy sector 
  • Working in or managing multidisciplinary teams across different departments or functional areas; 
  • Experience with planning and organizing market outreach events, speaking to audiences; and 
  • Supervision of construction and/or consulting contracts
