Oxfam in Nepal

Oxfam has been working in Nepal since the early 1980s undertaking various development initiatives addressing the poverty and injustice faced by women and other socially and economically excluded groups. The level of Oxfam's engagement increased substantially after restoration of democracy in 1990 as it became easier for civil society to work in the new political environment. Over the years, Oxfam has worked in partnership with local civil society organisations and the government to promote rural livelihoods, and vulnerable communities' resilience to climatic shocks and disasters. It has also significantly contributed to empowering community people, especially women, to; negotiate with people in power, influence decision making processes, claim rights and essential services to which they are entitled, demand accountability on the part of duty bearers and engage larger masses in advocacy efforts. Oxfam also worked closely with UNHCR in providing assistance to Bhutanese refugees during the 1990s. Oxfam and its long term programme partners believe that the underlying structural causes and drivers of poverty must be addressed if improvements in peoples's lives are to be broad and lasting. Poverty is not one-dimensional; nor is it purely local in its causes and solutions. Therefore, Oxfam's work addresses not only material and technical change, but also the related economic, social, institutional and policy changes which are necessary to end poverty and achieve development and wellbeing. The Oxfam Nepal Vision is: The people of Nepal are empowered and work together to attain a life of dignity with justice and equal rights for all. The Overall Nepal Programme Goal is: to improve the well being of vulnerable people through strengthening their participation in development and governance processes and reducing poverty and suffering.

Hiring a consultant for Due Diligence of Partner NGOs

Background

Oxfam in Nepal has been implementing its program in various themes with substantial budget being funded through multiple donors. Oxfam has been implementing its program in partnership with local NGOs in its program implementing districts. Oxfam works with 35 partner organizations during FY 2018 -19 to implement its program.

With the involvement of high number of partners in program implementation since long time, Oxfam has developed a good relationship with all its partners. All the partners have been selected with due selection process at the inception. Oxfam carries out the partners’ capacity risk assessment annually whenever required. Oxfam selects those NGOs for further partnership process whose objective supplements Oxfam objectives. During the course of time objectives and scope of work of the partners might have changed along with the change in context and working environment.  Furthermore, some of the partners are continuously implementing the programme activities together with Oxfam since a significant number of years (SWC PA 2005 – 2010). Familiarity with partners since long time might undermine the independence, objectivity and requirements.

As mentioned in the recent notice issued by Ministry of Home Affairs relating to organization registration and renewal, a NGO can renew the organization with only one objective. Although this instruction is on hold for now, this clause is not cancelled yet. As observed in the recent past (before issuance of this notice), a NGO could be registered and renewed with several objectives. With this notice and other government strategy to monitor the compliance of code of ethics strictly, it would be difficult for same NGO to operate and implement the program in multiple thematic areas. This provision would have a bigger impact in the ongoing partnership of Oxfam too.

With the above background, Oxfam intends to conduct a due diligence test of its ongoing partners.

Objectives of the Assignment 

  1. Assess the extent to which Oxfam’s strategy and objective match with and are supplemented by partner’s objectives and strategy 
  2. Assess partner’s existing capacity to deliver Oxfam’s program with quality standards
  3. Assess governance of partner organizations
  4. Assess partner NGOs internal control, operational guidelines, compliances and reporting standard 
  5. Identify key risks (if any) and recommend the areas of improvement of operation, program design, implementation and evaluation, fraud prevention and safeguarding  
  6. Assess the projects implemented by partners have met the value for money
  7. Seek recommendations from partners in program development, implementation, and review
  8. Assess policies on safety, safeguarding, gender child protection

 

Scope of Services and Tasks and Activities to be completed 

The due diligence will be conducted by an independent consultant. The Consultant is expected to conduct desk review as well as visit to partner organizations offices. Assessment criteria, benchmark and score in each evaluation will be developed by consultant with support from Oxfam. Oxfam will provide a standard template to the selected consultant to provide guidance on the assessment procedure.

Partners location: Kathmandu valley (9), (Gorkha (2), Dhading (3), Nuwakot (3), Sindhpalchowk (3), Makwanpur (1), Rautahat (1), Saptari (1), Sarlahi (1), Arghakhachi (1), Bake (2), Surkhet (2), Dadeldhura (1), Darchula (1), Baitadi (2), Dailekh (1), Kanchanpur (1) (number may vary slightly). 

Expected Deliverables

Oxfam country management expect following output from the due diligence process:

  1. An inception report with detailed methodology, indicators, assessment tools etc.
  2. An assessment / final report detail: 
    1. Strategic and objective fit in Oxfam and local partner NGOs
    2. Existing capacity of Partners NGOs to deliver program with quality 
    3. Ability to implement program in future opportunities 
    4. In depth report of Governance, operation modality of Finance, HR, fraud prevention, security and safeguarding, liability mechanisms, Admin, Logistic/procurement internal control process and compliance
    5. Value for money 
    6. GAP analysis and provide way forward 
    7. Key risks and recommendation to continue, continue with some capacity improvements, or discontinue partnership 
    8. Recommendation for Project partnership, Strategic partnership. 

Reporting Line Manager

This work is to be delivered to the Country Director/ Head of Business Support, Oxfam in Nepal and overseen by the management team.

Scope outputs will be signed off by Country Director/ Head of Business Support in order to ensure full delivery and timeliness. 

Duration: Start date and completion date

The estimated input of the consultant is 2 months. The assignment is expected to start on first week of August 2018 be finalised by no later than First week of October.

 Terms of Payment 

  • First instalment of 30% will be paid after submitting the Inception report.
  • Final Instalment of 70% will be paid after submitting the final Assessment report.

 Response 

The Consulting VAT Registered Individual/Firm should submit a proposal to Oxfam by 29 July 2018 via mail to consultancy_nepal@oxfam.org.uk, clearly mentioning the title of assignment in their email subject line. 

Confidentiality / Non-Disclosure

All material issued in connection with this ToR shall remain the property of Oxfam and shall be used only for the purpose of this procurement exercise. All information provided shall be either returned to Oxfam or securely destroyed by unsuccessful applicants at the conclusion of the procurement exercise.

During the performance of the assignment or at any time after expiry or termination of the Agreement, the Consultant shall not disclose to any person or otherwise make use of any confidential information which s/he has obtained or may in the course of this agreement relating to partner organization/Oxfam, the respondents or otherwise.

The consultant will be required to sign a non disclosure / confidentiality agreement as part of their undertaking of this work. 

Intellectual property, Copyright, and Ownership of all prepared information

The Consultant shall retain all rights to pre-existing (background) intellectual property or materials used by the Consultant in the delivery of this study. All arising intellectual property, ideas, materials, processes or processes formed in contemplation, course of, or as result of this study shall be passed to Oxfam without restriction.

The Consult shall warrant that all arising Intellectual Property, materials and/or products produced in pursuit of this study shall be original, and shall not infringe on any third party’s claim. All technical or business information, in whatever medium or format, originated, collated or prepared by or for the Consultant in contemplation, course of, or as result of this assignment shall be transferred to Oxfam without restriction on completion and shall not be used by the Consultant for any other purpose without express written permission of Oxfam’s Head of Programme Funding.

Copyright of all arising documents, data, information or reports produced by the Consultant under this agreement shall belong to Oxfam and will be passed to Oxfam without restriction. Such documents, data, information and reports shall not be used by the Consultant for any other purpose other than in conjunction with this assignment, without the express written permission of Oxfam’s Head of Programme Funding.
