Consultant – To develop and prepare National Trafficking in Persons (TIP) report of National Human Rights Commission (NHRC)”.

BACKGROUND:

Trafficking in Persons (TIP) is a global problem that is multidimensional and multisectoral and thus is a complex issue that requires multi-disciplinary solutions with many stakeholders. Nepal is a source, transit, and destination country for sex, labor, and organ trafficking. The 2018 “Walk Free Foundations Global Slavery Index” revealed that two third out of 40.3 million people around the world who have been living under the modern slavery are in Asia and the Pacific. Out of them 70 percent are women and girls. According to that data 6 percent of total population of Nepal are compelled to live under modern slavery (Walk Free Foundations Global Slavery Index can be accessed here). The Hamro Samman project brings together various stakeholders and implementing partners to reduce the prevalence of trafficking-in-persons in Nepal. It is a five-year program generously supported by the American people through the United States Agency for International Development (USAID) and the British people through UK Aid and implemented by Winrock International. It seeks to build the capacity of and facilitate coordination among the Government of Nepal (GON), civil society, and private sector to combat human trafficking in Nepal.

OVERVIEW:

National Human Rights Commission (NHRC) of Nepal is an independent and autonomous body entrusted with a constitutional mandate for the protection, promotion, and enforcement of the human rights in Nepal. Since its inception, NHRC has been implementing various interventions, as guided by its strategic documents, to combat human trafficking in Nepal. NHRC recognizes that TIP violates the right to liberty, human dignity, and the right not to be held in slavery or involuntary servitude. National Human Rights Commission (NHRC) in close collaboration with Hamro Samman Project aims to develop and rollout a comprehensive TIP report that aims to analyze the situation of Trafficking in Persons (TIP) in Nepal The report will also focus on impact of COVID-19 on human trafficking and foreign labor migration sectors. TIP report will evaluate the effectiveness of interventions carried out by different Governmental and Non- governmental organizations and examine the implementation status of the recommendations forwarded by the National Human Rights commissions including previous National Reports of NHRC on TIP and other recommendations related to TIP..

Thus, Hamro Samman seeks a consultant to develop and prepare National Trafficking in Persons (TIP) report of NHRC.

TASK AND OUTPUT:

The consultant will be required to coordinate with Hamro Samman Program team and NHRC to develop and prepare national TIP report of NHRC.

The consultant will make the following deliverables:

  • To develop and prepare National TIP report. 

To achieve the objective, the consultant is expected to undertake the following tasks:

Task 1: To develop and prepare National TIP report in close coordination with NHRC and Winrock International, Hamro Samman.

Timeline for the submission of the report

  • Conduct comprehensive review and critical assessment of implementation status of government’s efforts to combat Trafficking in Persons in Nepal.
  • The report should properly highlight the efforts and achievements of the government, NHRCN and the civil society, including international organizations, to curb trafficking in Nepal and to address the plights of the victims.
  • Scope of work and the methodology need to be clear to ensure quality and validity of the report
  • Assess existing institutional as well as the normative framework related to CTIP including Constitution, relevant laws, policies and judicial decisions, identify the gaps in the government measures versus the de facto status of implementation of these measures
  • Identify and critically analyze existing policies, plans, GON commitments at all spheres of government to combat human trafficking, identify the measures, interventions and strategies to address CTIP.
  • Conduct desk review of international commitments of Nepal to combat with trafficking and identify gaps in implementation and prescribe specific recommendations to address these gaps.
  • Facilitate series of consultations, meetings, key informant interviews, focus groups discussions to obtain timely and accurate information for the report
  • Review, analyze and share the findings based on NHRC Interventions related TIP cases
  • Obtain, collate, and analyze data, information, case studies gathered from civil society and other sources related to human trafficking
  • Work in close coordination with the Focal officer of TIP and the research Expert Group to identify the areas needing supplementary information and analysis, and conduct additional research on the basis of a) various reliable secondary information, and b) activities such as workshops undertaken as per the research design to prepare the report and to address the lacunae in the draft report.
  • Participate in the meetings with various stakeholders to discuss the draft report and examine the feedbacks and incorporate them, if appropriate.
  • Submit the final writing on Situation of Trafficking.
  • Conduct additional research study on the issues and information that will be required in the process chapter write up, reviewing, and editing the report.
  • Review translation of research report to ensure accuracy and work closely with the translator and editor of the report.
  • To support strengthening data management within NHRC.
  • The duration of the report will cover two-year 2020 and 2021.
  • Number of days for the assignment considering the scope of work need to be finalized

The total assignment date is 30 days including travel.

QUALIFICATIONS:

Education:

  • Master’s Degree in Law, Human Rights or Social Sciences from a recognized institution. Knowledge about trafficking related issues is a must. PHD in Human Rights or Social Sciences or Gender is an asset.

Technical:

  • Proven ability to apply various research methodologies to produce valid research reports. Able to write high quality analytical reports in a clear, concise, accurate and persuasive manner.
  • General knowledge of human rights conventions related to trafficking, Convention on the Rights of Children, Convention on the Elimination of All Forms of Discrimination against Women.
  • At least 10 years of extensive experience of research and research report writing work. Prior research work in the field of human trafficking and migration will be an asset.
  • Good understanding of human rights related national and international laws (particularly trafficking and migration related).
  • Good practical knowledge of MS Word and MS Excel.
