Title: Consultancy for the assignment of Child Protection policy development and GESI Policy Review of Partner Organisation of Oxfam

 Terms of Reference (ToR) 

Background

Oxfam is an international confederation of 18 organizations networked together in more than 90 countries as a part of a global movement for change, to build   future free from the injustice of poverty. Oxfam has been working in Nepal since the early 1980s undertaking various development initiatives addressing the poverty and injustice faced by the population, especially women and other socially and economically excluded groups. Currently under Humanitarian and DRR Department Oxfam is working in two Earthquake affected districts namely Sindhupalchowk and Nuwakot through six local partners and Kathmandu Valley through national partners. Our interventions target the most vulnerable specially women and those with unequal access to resources such as Dalits and other caste/ethnic minorities. 

In the delivery of our work, Oxfam has committed to upholding the rights of children, and safeguarding them against actions (intended or unintended) that place them at risk of all forms of violence and harm, including child neglect, abuse and exploitation. The responsibility of maintaining child safe environments is a shared responsibility of all Oxfam/partner staffs. So, Oxfam intended to institutionalize GESI and child protection both at organizational and operational level. For this Oxfam is going to support its partner organization to develop their child protection policy and to revise child protection policy if it is already in place with partners.

Besides, in fiscal year 2017-2018, Oxfam has supported partners to develop GESI policy. It has already been a year of its development. Hence Oxfam also opts to review (follow up) the implementation status of those policies and existing  gaps/ challenges associated with it  with it if any.  

Objectives of the Assignment

  • To develop/revise child protection policy of 8 partners (3 in Nuwakot, 3 in Sindhupalchowk and 2 in Kathmandu)
  • To review existing GESI policy of partners, explore the status of its implementation, also the gaps and challenges associated with it if any.  

Scope of Services and Tasks and Activities to be completed

The overall scope of this consulting assignment is to develop/revise partner’s child protection policy and interact about GESI policy of partners.

Activities will include, but may not be limited to, the following: 

  • Develop workplan for partner’s Child protection policy development/revision and review partners’ existing GESI Policy
  • Conduct workshop with partners to develop/revise Child protection policy and review partners ’existing GESI policy
  • Finalize child protection policy of 8 partners organisation at Nuwakot, Sindhupalchock and Kathmandu in close coordination and consultation with respective partners and Oxfam Gender Officer.   

Expected Deliverables

  1. Read, familiarize and internalize Oxfam Australia and Oxfam Great Britain’s documents on Child Protection policies, partner’s  policies, procedures, guidelines, toolkit etc. 
  2. Read, familiarize and internalize Nepali and local laws, rules, regulations, customs and practices around GESI and Child protection/safeguarding. 
  3. Review the existing GESI policy of partners and provide recommendation for its effective implementation as per need.
  4. Finalised copy of Child protection policy of partners (at least 8 partners) in Sindhupalchowk, Nuwakot and Kathmandu. 
  5. Final report of workshop conducted with partners (1  workshop in each district- Nuwakot, Sindhu, Kathmandu which includes child protection policy development and partners’ existing GESI policy review) 

Reporting Line Manager

This work is to be reported directly to the Gender Officer, Oxfam in Nepal and overseen by the Head, Humanitarian and DRR/CCA.  

Duration: Start date and completion date

The estimated duration for this assignment is tentatively 21 days. The assignment is expected to start on September 2018. 

Location

The consultant is required to visit Nuwakot, Sindhupalchowk and Kathmandu for Child Protection policy workshop and also partners’ GESI policy review.  

Required Knowledge and Skills

  • Significant experience (>5 years) working on child rights and child protection issues, within Nepalese context (with demonstrated understanding of international best practice)
  • Proven experience implementing Child protection and GESI policies through programming
  • Proven experience developing and delivering contextualized Child protection and GESI  training
  • Demonstrated understanding of rights-based approaches to programming
  • Ability to deliver a high-quality report in a timely manner 
  • Language requirements - English and Nepali 

Selection Criteria

  • Consultant/Consulting firm should have at least five years’ experiences on gender, women’s rights and child protection - 20
  • Agency should have experience of developing child protection policy and GESI policy of different organization in past – 20
  • Experiences related to coordination and facilitation - 10

Payment will be done in three instalments.  Terms of Payment

  1. 1st instalment: 20% of payment will be made after the contract signing.
  2. 2nd instalment: 30% of the payment will be made after receiving the final report of workshop conducted with 8 partners. 
  3. Final Instalment: 50% of payment will be made after receiving the Finalised copy of Child protection policy of partners (8 partners) in Sindhupalchowk, Nuwakot and Kathmandu and event completion report.

Response 

The Consulting VAT Registered Individual/Firm should submit a proposal to Oxfam by 26 August 2018 via mail to consultancy_nepal@oxfam.org.uk, clearly mentioning the title of assignment in their email subject line. 

Confidentiality / Non disclosure

All material issued in connection with this ToR shall remain the property of Oxfam and shall be used only for the purpose of this procurement exercise. All information provided shall be either returned to Oxfam or securely destroyed by unsuccessful applicants at the conclusion of the procurement exercise.

During the performance of the assignment or at any time after expiry or termination of the Agreement, the Consultant shall not disclose to any person or otherwise make use of any confidential information which s/he has obtained or may in the course of this agreement relating to partner organization/Oxfam, the respondents or otherwise.

The consultant will be required to sign a non-disclosure / confidentiality agreement as part of their undertaking of this work.  

Intellectual property, Copyright, and Ownership of all prepared information

The Consultant shall retain all rights to pre-existing (background) intellectual property or materials used by the Consultant in the delivery of this study. All arising intellectual property, ideas, materials, processes or processes formed in contemplation, course of, or as result of this study shall be passed to Oxfam without restriction.

The Consult shall warrant that all arising Intellectual Property, materials and/or products produced in pursuit of this study shall be original, and shall not infringe on any third party’s claim. All technical or business information, in whatever medium or format, originated, collated or prepared by or for the Consultant in contemplation, course of, or as result of this assignment shall be transferred to Oxfam without restriction on completion and shall not be used by the Consultant for any other purpose without express written permission of Oxfam’s Head of Programme Funding.

Copyright of all arising documents, data, information or reports produced by the Consultant under this agreement shall belong to Oxfam and will be passed to Oxfam without restriction. Such documents, data, information and reports shall not be used by the Consultant for any other purpose other than in conjunction with this assignment, without the express written permission of Oxfam’s Head of Programme Funding.
